Mähriban hormatly agzalar, Biz Türkmenistandaky aýallaryň ýagdaýyny we döwletiň heniz hem aýallary zorlukdan hem-de diskriminasiýadan goramakda öz borçlaryny ýerine ýetirip bilmeýändigini ara alyp maslahatlaşmaga berlen bu mümkinçilik üçin Komitete minnetdarlygymyzy bildirýäris. Bu interwensiýada biz döwletiň uly kemçilikleriniň käbiriniň üstünde durup geçeris.

Birinjiden, Türkmenistanda aýallary öýdäki zorlukdan goraýan talabalaýyk kanunçylyk ýetmezçilik edýär. Biz häzirki kada-kanunlaryň zerur standartlary berjaý etmeýändigi we pidalara-halas bolanlara ýeterlik goraglylyk üpjün etmeýändigi barada derňewimizi bu Komitete ýetirdik. Bu ýerde men häzirki ulgamyň käbir şowsuzlyklaryny gysgaça belläp geçmekçi we goşmaça maglumat üçin hormatly agzalary biziň doly hasabatymyzy okamaga çagyrýaryn:

Ikinjiden, biziň hasabatymyzdaky şaýatnamalar aýallaryň biabraýçylykdan we köpçüligiň tankytlamasyndan çekinip öýdäki zorluk barada arz-şikaýat etmeýändiklerini görkezýär. Olaryň köp sanlysy pidalar üçin sosial-ykdysady, psihologik goldaw, şol sanda bar bolan gaçybatalgalar barada hem bilmeýändiklerini aýratyn nygtadylar.

Üçünjiden, biziň ýakynda geçiren derňewlerimiz onlaýn dünýäde aýal-gyzlara garşy zorlugy öňe sürýän kontentiň kändiginiň we munuň Türkmenistanda aýal-gyzlara garşy ýigrençli diliň we öýdäki zorlugyň artmagyna goşant goşýan bolmagynyň mümkindiginiň üstüni açdy.

Biz hormat bilen CEDAW Komitetinden döwlete şu maslahatlary bermegi haýyş edýäris:

↪ CEDAW we beýleki halkara adam hukuklary standartlaryna eýerýän gender esasly zorluga we öýdäki zorluga degişli kanun taýýarlamagy hem-de kanuny düzmekde we taýýarlamakda raýat jemgyýetiniň ähmiýetli gatnaşygyny gazanmagy ileri tutuň.

↪ Haýal etmän, Jenaýat kodeksini, Jenaýat iş ýörediş kodeksini, we Administratiw kodeksi bu şädow hasabata birikdirilen awtoryň teswirnamasyna laýyklykda rejeläň.

↪ Raýat jemgyýeti guramalaryň ähmiýetli görkezmelerine we maslahatlaryne salgylanyp, gender esasly zorlugyň pidasy bolan aýallaryň kemsidilmegine çäre görüň.

Dear Honorable Members, We thank the Committee for this opportunity to discuss the situation of Women in Turkmenistan and how the State still fails to fulfill its obligations to prevent and protect women from violence and discrimination. In this intervention, we highlight some significant shortcomings of the State.

First, Turkmenistan lacks adequate legislation aimed at protecting women from domestic violence. We provided an analysis to this Committee indicating how current legislation does not fulfill the necessary standards and lack sufficient protection for victim-survivors. Here, I will briefly describe some of the current system's failures and invite the honorable members to read our report for further information:

↪ Law enforcement agencies frequently choose to qualify domestic violence as an "administrative offense", and only if committed repeatedly is it considered a criminal offense.

↪ Current statutes do not adequately address violence relating to low-level injuries, threats of bodily harm, and the use of power and control in relation to domestic violence.

↪ Lastly, the legislation lacks adequate support for victim-survivors.

Second, testimonies in our report demonstrate that women do not report domestic violence due to shame and fear of public judgment. Many individuals emphasized the absence of knowledge about socio-economic and psychological support for victims, including access to and knowledge about a few available shelters.

Third, our recent findings revealed that content promoting violence against women and girls online is prevalent and is likely contributing to increased incidences of hateful speech and domestic violence against women and girls in Turkmenistan.

We respectfully request that the CEDAW Committee recommends that the State Party:

↪ Draft a law addressing gender-based violence and domestic violence in line with CEDAW and other international human rights standards, and with the meaningful participation of civil society on the conception and drafting of the law as a matter of priority.

↪ Amend the Criminal Code, Criminal Procedure Code, and Administrative Code in line with the authors’ commentary appended to this shadow report on an urgent timeframe.

↪ Address the stigmatization of women who are victims of gender-based violence with substantive guidance from civil society organizations.

↪ Allow the creation and registration of nonprofit groups, specifically those working on issues of gender-based violence, and provide them with opportunities to meaningfully engage with the state.
